I got an e-mail this morning from a guy who claims that he has a copyright on the name "Bitter Midgets". Here is his original message along with my reply. Is anyone studying copyright law?

To whom it may concern:

Id like to inform you that a Mr. Anthony Fowler is illegally using the name Bitter Midgets, which I have copyrighted and Trademarked as my own. He must cease and desist all usage of this name, and since it is posted on your site Id greatly appreciate if you would contact said individual and have him get in touch with me as soon as possible so there will be no need for any legal action. Thank you for your time, and have a nice day-

Could you give me more information about this copyright you hold?
I did a brief search on the Internet and found no mention of a copyrighted "Bitter Midgets". My search at copyright.gov also turned up nothing.

I'm not an intellectual property rights lawyer, but I have researched this topic before.
We have been using the name "Bitter Midgets" on our site for over a year now. It seems that use of "Bitter Midgets" on my site pre-dates any copyright that you may hold. Whether or not this is true, I believe that use of "Bitter Midgets" on my site would fall under the "Fair Use" doctrine of US copyright law.

Our non-commercial use of "Bitter Midgets" is not a threat to your use of "Bitter Midgets", whatever that may be.

i got it...maybe when the guy went to copyright it he spelled it wrong, ask him if he spelled it:

biter midget, or midget biter (either way)
mitter bidget
or maybe he got it completly wrong and accidentally copyrighted ... rettib tegdim
